CLS has built a highly experienced underwriting team with a range of experience (from both US-based title insurance companies’, UK companies’ and Lloyd’s underwriting backgrounds) which is considered second to none in the UK. CLS combines established risk assessment processes and a broad range of technical experience within the underwriting team. As a result, clients seek out and trust
CLS’s quotes, particularly in relation to more complex title-related matters. The mainstay of UK Commercial Title Indemnity business is typical of a mature market, being “known risk” applications (i.e. where a specific title problem is addressed). In this regard,
CLS has developed a generic policy form capable of addressing the broad range of standard title risks e.g. restrictive covenants, absence of easements through to more complex issues such as rights of light and village greens.
In addition
CLS has partnered with Landmark Information Group to provide the scheme insurance solutions for residential and commercial contaminated land.
CLS has also pioneered the development of these polices to offer cover where a further action or failed report has been returned and to increase cover on Envirosearch search products.
CLS has worked with leading members of the professional community (Barristers, RICS) to develop appropriate risk management strategies that embody sound commercial practice and can be supplemented by insurance. In particular,
CLS has recently partnered RICS to establish accepted conduct in the context of use of insurance to address developer’s exposure to rights of light-related risk. Members of the underwriting team have also developed underwriting techniques to allow insurance to be used to manage extensive property due diligence exercises in large commercial portfolio and M&A transactions.
